1. This Sweepstakes is sponsored by Nutrient Survival LLC (“Sponsor”).

2. Eligibility: Own a Piece of Freedom (the "Sweepstakes") is only open to those who are 18 years of age as of the date of entry. The Sweepstakes is only open to legal residents of the United States, and is void where prohibited by law. Employees, independent contractors, interns, officers, directors, and agents of Nutrient Survival LLC (the "Sponsor") their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited.

3. Agreement to Rules: By entering the Sweepstakes, the contestant ("You") agree to comply with and abide by these Rules and the decisions of the Sponsor, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the Sponsor's decisions as final and binding as it relates to the content of this campaign. Entrants should look solely to the Sponsor with any questions, comments or issues related to the Sweepstakes.

4. Entry Period: The Sweepstakes begins at on 04/01/2024 at 12:00AM PDT and ends at on 09/30/2024 at 12:00AM PDT (the "Entry Period"). Entries submitted before or after the Entry Period will not be eligible.

5. TWO WAYS TO ENTER:

a) Automatic entry.  You will receive one (1) automatic entry for every order placed at nutrientsurvival.com (the “Website”), during the Promotion Period. Bonus Entry: Throughout the Promotion Period, the Sponsor may announce opportunities to earn double entries (a “Double Entry Offer”). When a Double Entry Offer is offered, the number of entries earned will be multiplied by 2. Timing for a Double Entry Offer will be determined solely by the Sponsor and will be announced by the Sponsor on the Website, via Email, or its social media pages. 

Automatic entries and bonus entries must be received by 11:59:59 PM ET on 09/30/2024 to be eligible for this Sweepstakes. If a qualifying purchase is returned prior to the drawing, entry/ies associated with that purchase will be voided. All purchases are subject to Sponsor’s return policy.

b) No Purchase Necessary – Mail-in Method of Entry.

To enter the Sweepstakes without making a purchase, on a plain piece of 3”x5” paper, hand print your complete first and last name, street address, city, state/province/territory, zip/postal code, date of birth (mm/dd/yyyy), e-mail address plus daytime telephone number including area code. Mail your entry in a #10 business-size envelope with first-class postage affixed to: Nutrient Survival, 110 Woodland Ave, Reno, NV 89523 USA. Your outer-mailing envelope must include a valid return address, which includes a complete first and last name. Mailed entries received without a verifiable and legible return address will be deemed incomplete and invalid. Limit one entry per outer-mailing envelope. Bulk shipments (multiple entries in one shipping package) will not be accepted. Mail-in entry, including outer-mailing envelope must be handwritten. No mechanically reproduced entries or metered mail permitted. Mail-in entries must be postmarked by 09/30/2024, and received by 10/07/2024 to be eligible for the random drawing. Each mail-in envelope will count as 1 entry, provided that the mail-in entry complies with the above requirements. Mail-in entries received with postmarks that correspond to a Double Entry Offer will receive 2 entries.

Mail-in entries that are not in the format specified above, that are illegible, inaccurate, incomplete, or reproduced via photocopier or otherwise will be considered null and void. Proof of submission does not constitute proof of receipt. Not responsible for lost, late, illegible, mutilated, misdirected, postage-due entries or entries not received by the deadline. All material submitted becomes property of Sponsor and will not be returned. No correspondence will be acknowledged or entered into; requests for confirmation of receipt of mail-in entries will not be acknowledged.

6. Prize: A single (1) prize will be available to be won and awarded in this Sweepstakes (the "Prize”) as described below.

THE PRIZE.  The "Prize," the awarding of which will be subject to the terms and conditions of these Rules, will consist of cash in the amount of ten thousand dollars in U.S. currency (US$10,000) to be used to make a Qualifying Purchase (defined below) of real estate that the Winner (as defined below) would purchase and own. Additionally, the Winner will receive a Nutrient Survival 90-Day Emergency Food Kit with a retail value of one thousand eight hundred and ninety dollars (US$1,890)

The fair market value ("FMV") of the Prize is US$11,890.

A "Qualifying Purchase" of real estate for purposes of the official rules means a bona fide purchase of real estate located in one of the 50 U.S. states or D.C., where such purchase is one: (i) that is in full compliance with these rules and all applicable laws, regulations, codes and contractual obligations; (ii) that does not include use of any part of the prize to pay off, pay down, reduce, or otherwise off-set any existing mortgage, encumbrance, loan, or debt; (iii) that applies to real estate not occupied by winner or any of winner's immediate family members prior to the purchase; (iv) that is not a rental or lease transaction; (v) that does not involve a purchase from (or sale to) any of winner's immediate family members; (vi) that has a bona fide purchase price of at least the value of the prize less any tax obligation owed, or that will be owed, based on the winning or awarding of the prize; and (vii) for which the closing is completed within 360 days after the entrant is notified that they have been confirmed as winner of the prize. If this time requirement is for any reason not met, then such entrant may be deemed by Sponsor (in Sponsor's sole and absolute discretion) to have declined to accept the Prize. Sponsor reserves the right, however, in its sole and absolute discretion, to extend the deadline to close on the home purchase transaction.

Winner is responsible for any balance of real estate purchase price due after remittance of the Prize amount (less any tax withholding), and all other prize related fees, expenses, costs, insurance, escrow amounts, taxes (whether real estate taxes, transfer taxes, stamp taxes, recording fees, sales tax, use tax, property tax or otherwise) and other amounts whatsoever, as well as any federal, state, or local income taxes due as to the Prize.

A winner may waive the right to receive a prize. Prizes consist of only those items specifically listed as part of the prize. Prize must be used. Any costs associated with acceptance and use of the prize not specifically mentioned herein are the sole responsibility of the winner. No substitution or transfer/assignment of prize by winner permitted. Prizes cannot be redeemed for cash. The prize is nontransferable. Substitution of the prize or transfer/assignment of the prize to others or request for the cash equivalent of the prize by the Winner is not permitted. Acceptance of the prize constitutes permission for the Sponsor to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

You acknowledge that the amount of taxes due related to the Prize may vary based on the applicable federal, state and local tax laws, and the Winner is solely responsible for all such amounts.

WINNER IS STRONGLY ENCOURAGED TO ENGAGE THE SERVICES OF A TAX ADVISOR, AT THE WINNER'S SOLE EXPENSE, TO ASSIST WINNER IN CONSIDERING AND MAKING ANY NEEDED DETERMINATIONS BEFORE THE AWARDING OF THE PRIZE.

Notwithstanding any terms of these Rules (including, without limitation, any examples set forth in these Rules), Sponsor shall have the right to withhold funds from any Prize-related remittance to the extent Sponsor determines to be necessary or advisable to meet or anticipate any federal, State, local or other tax withholding obligations, or other obligations, of Sponsor or Winner.

7. Odds of Winning: The odds of winning depend on the number of eligible entries received.

8. Winner Selection and Notification: The Winner will be selected by Random Draw under the supervision of the Sponsor. The Winner will be notified within 7 days of the winner selection. The Sponsor shall have no liability for a Winner's failure to receive notices due to spam, junk e-mail or other security settings or for a Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner cannot be contacted, is ineligible, fails to claim the prize within 7 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited, and an alternate Winner selected. Receipt of the prize offered in this Campaign by the Winner is conditioned upon compliance with any and all federal, state, and local laws and regulations. Any violation of these official rules by the Winner at the Sponsor's sole discretion will result in the Winner's disqualification as winner, and all privileges as winner will be immediately terminated.

9. Rights Granted by the Entrant: By entering this content (e.g., photo, video, text, etc.), You understand and agree that the Sponsor and anyone acting on behalf of the Sponsor or its respective licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. By entering this content, you represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, you will be disqualified at the sole discretion of the Sponsor. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Sponsor from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Sponsor may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

AUTHORIZATION TO SEND MARKETING COMMUNICATIONS.  By entering the Sweepstakes using the Prescribed Entry Method, you authorize the Sponsor and Administrator and their respective affiliates and independent contractors to make use of the email address, home, office and cellular telephone numbers and any other information you submit to send you electronically or in any other format until such time (or a reasonable time thereafter) as you withdraw such authorization (e.g., by unsubscribing from such messages via an un-subscribe link in an email message you might receive).  Sponsor and Administrator and their respective designees remain free to contact you by email, text, phone call or otherwise, however, for any purpose relating to operation or administration of the Sweepstakes.

10.  Terms and Conditions: The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes should virus, bug, non-authorized human intervention, fraud, or other cause beyond the Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such cases, the Sponsor may select a winner(s) from eligible entries received before and/or after the action taken by Sponsor if appropriate. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Terms & Conditions. The Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to: the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.

11.  Limitation of Liability: By entering the Sweepstakes you agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) unauthorized human intervention in any part of the Sweepstakes; (iii) electronic or human error in the administration of the Sweepstakes or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail.

12.  Disputes: This Sweepstakes is governed by the laws of United States, without respect to conflict of law doctrines. By participating, you agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in United States. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than actual out-of-pocket expenses (i.e. costs associated with entering the Sweepstakes). You further waive all rights to have damages multiplied or increased.

13.  Winners List: To request a copy of the winners list please contact the Sponsor. Requests must be sent within four (4) weeks of the end of the Entry Period.

14.  The Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social networks that are used to share the Sweepstakes. You understand that you are providing your information to the owner of the Sweepstakes and not to Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social networks.

15.  Acceptance of Rules: By participating in the Sweepstakes, You have affirmatively reviewed, accepted, and agreed to all of the Official Rules, Terms and Conditions.
